Retaining an Attorney in a Criminal Case

You have a right to retain an attorney at any time during the progression of your case.  
Depending on the type of crime you are accused of, it may become mandatory for you to
be represented by counsel.  If you decide to hire a private attorney, it is in your best
interests to do so at the start of your case.

If you believe that you cannot afford a private attorney, you will be interviewed by the
Public Defender’s Office to determine whether or not representation is available through
this agency.  If you meet the requirements of the agency, a Public Defender will be
appointed to represent you through the completion of your case.  If, however, this
agency determines that you do not qualify for assistance, it may be necessary to retain
private counsel.

Hiring an criminal defense attorney to help you with your case can be challenging.  People
want good representation, at a reasonable rate, to have a lawyer who will fight for them.  
One should be careful about retaining an attorney who makes promises about the outcome
of your case - especially ones promising things that just seem too good to be true.  You
should also ask what experience the attorney has in handling criminal cases and how much
of their practice is devoted to handling criminal cases.  Be sure to ask if they ever handled
your type of case and if they have ever done a criminal trial, and if it was a jury trial.  If
they are new to handling criminal cases, it does not mean they are a bad attorney (in fact
they could be a great attorney), but ask if they have anyone who is experienced in
handling criminal cases, that can provide them with advice if needed.

Each case is different as each case will have different facts, different prosecutors, and
different judges.  While an attorney can say they will work for a particular resolution - no
one can guarantee a particular result.
